Treviso, 8 May 2024 – Curia Mercatorum is the Mediation and Arbitration Centre established in 1995 on the initiative of the Chamber of Commerce of Treviso, now the Chamber of Commerce of Treviso-Belluno (after the merger, in 2016, with the Belluno entity), in order to achieve the purposes attributed to Chamber entities by Law 580/1993.
The initiative immediately involved other chamber bodies and several trade associations of both business and professional nature.
The main focus of the Association,’ highlights President Pozza, ’is to offer the Mediation service, not only for businesses, but also for situations that arise in people’s everyday lives. It is, in fact, an alternative method of dispute resolution that is characterised by the intervention of a third and neutral professional, the mediator, who assists the parties in order to reach an agreement on the problem that has arisen. To date, the Association offers mediation services in four of the seven Veneto provinces: for the Chamber offices of Treviso, Belluno, Venice and Rovigo. As for the average dispute value per matter, the main figures for 2023 are as follows: company rents (€ 554,156.36), healthcare liability (€ 364,570.01), hereditary succession (€ 331,192.00), company law (€ 264,090.00), medical liability (€ 251,104.91), and division (€ 236,243.40). I invite,’ urges President Pozza, ’to take advantage of this important mediation architecture given also the collaboration agreement with the Milan Chamber of Arbitration, aware that arbitration plays a fundamental role in strengthening the competitiveness of companies. Arbitration has grown by 28% in the last four years, leading to a 7% reduction in the proceedings’ duration. A leaner justice system expresses a stronger economy. However, it is crucial to be aware of the new opportunities provided by the justice reform.
With D. No. 28/2010, mediation became a procedural condition for legal action in a whole series of matters of a different nature, inheritance, divisional, corporate, business leasing, real rights and so on.
With the recent Cartabia reform, a little more than ten years after the entry into force of compulsory mediation, the legislator has expanded the number of matters in which mediation must be attempted before taking legal action (including partnerships, work, administration, subcontracting).
The Data
From 1997 to 31.12.2023, the Association administered a total of 7484 procedures (as of today, 06.05.2024, the Association has administered a total of 7697 procedures).
A total of 544 mediations were administered in 2023, and as to the nature of the cases activated, 446 were of a compulsory nature and 98 voluntary mediations.
Then, with regard to the main subjects of mediation, of the 544 requests, 108 related to real rights, 63 to division, 58 to succession, 60 to leases, and 49 to condominium matters.
With regard to territorial jurisdiction, 267 procedures were handled in Treviso (242 in 2022, 272 in 2021, 220 in 2020, 221 in 2019, 228 in 2018, 287 in 2017), 146 in Belluno (164 in 2022, 144 in 2021, 135 procedures in 2020, 128 in 2019, while 103 were in 2018, 95 in 2017), 48 in Venice (63 in 2022, 89 in 2021, 50 in 2020, 38 in 2019) and 83 in Rovigo (65 in 2022, 72 in 2021, 53 in 2020, 27 in 2019).
